Defense Against Bankruptcy Proceedings
As part of our commercial collections practice, we help creditors litigate claims to collect debts after debtors have gone into bankruptcy. This involves securing relief from automatic stays and from discharge injunctions. We also defend against claims by trustees and debtors-in-possession to recover fraudulent conveyances or preferential transfers.
In addition, we represent creditors in claims where a piece of real estate has fallen into bankruptcy. We petition the court to get the property out of bankruptcy so that the client can pursue collection actions more strongly.
